Minutes of the PALA Director's Meeting

1.

APPROVAL OF PALA/POA BUDGET
The Directors approved the budget and levy increase.  It was decided that the documents be forwarded to all owners as soon as possible so that the levy increase could be implemented from 1st March 2009.

CABLE REPAIRS - DIDIMALA
The expenditure was approved.  Attempts to recover the costs from insurers have not been successful.

SECURITY
JM advised that he had introduced a system since September 2008 whereby all temporary workers or delivery men are required to obtain a badge at the main gate. Permanent workers are issued with permanent badges displaying their names and ID numbers. No workers are allowed on Rooibank without displaying the badge on their overalls.  DH advised that such a system had previously been operated for POA employees.  DH undertook to once again implement a similar system and he would discuss with Eddie.  CDT asked if any further burglaries or security related incidents had occurred since the start of the year.  No incidents had been reported.

FENCING SKILPADGAT
JM advised that although he is not representing the owners of Skilpadgat, the participating owners of Skilpadgat had not signed the DLIO. JM advised that any decision to upgrade the fencing around Skilpadgat would require consultation with such owners.

5.

GAME FENCE AROUND DIDIMALA
JM advised that the owners of Didimala had not signed a DLIO as they did not intend to participate in the Dinokeng Scheme.  It is a condition that landowners who do not participate in the Dinokeng Scheme will find themselves “fenced out” by Dinokeng.  The owners of Didimala are to present a fencing proposal to PALA CVD pointed out that Didimala and Pumba camp cannot be fenced out in terms of certain regulations as stated on their title deeds.  CVD also pointed out there regulations may be amended.

6.

RIGHT OF WAY OVER PORTION 77 WELGEVONDEN
JM advised that the road which passes on the Northern side of the dam and which is graded by POA had exceeded 4 meter in width which is contra environmental laws.  This road will no longer be graded (or cleared with the tyres) by POA.  There is no intention to close the road. It must be left alone to become a road with two wheel tracks.

CANCELLATION OF PARTICIPATION AGREEMENT PORTION 1 ROOIBANK AND PORTION 2 WELGEVONDEN
Under this point on the agenda, JM raised the following point.
JM advised that he would be putting a proposal to POA members (refer PALA directors meeting 31 January 2008) whereby  90 hectares of the most northern point of Rooibank be exchanged for 90 hectares of the new “Wolfaardt” property which will have the effect that POA common property is no longer divided by Rooibank.  Should Rooibank be withdrawn from Dinokeng it will have to be fenced out with the result that it then can no longer form part of POA. The Directors indicated that decisions of this nature cannot be dealt with at a PALA directors meeting.  Once a proper proposal had been received the project will be forwarded to POA owners for comment and vote.  It was also pointed out that the exchange proposed for Rooibank will not affect the status of the POA Nature Reserve Scheme as long as Rooibank remains a Participating owner.  DH asked JM would he be developing any portions of the new 90 hectares to which JM advised that he would undertake no additional development on this property.

WITHDRAWAL OF PORTION 1 ROOIBANK AND PORTION 2 WELGEVONDEN FROM DINOKENG
JM advised that his DLIO had certain exit clauses.  Should he be prevented from developing Rooibank he may exit the Dinokeng Scheme. JM expressed the opinion that this may lead to the cancellation of the Participation Agreement with POA as Rooibank will have to be fenced out of Dinokeng and all game be removed.

 

9.

TRAVERSING RIGHTS
No finalisation had been reached on traversing rights with Mongena.  It was however decided to propose that Mongena traverse on the “new Wolfaardt” property as an interim measure.  It must also be noted that participating owners must negotiate their own traversing rights directly with Mongena.  It was however, suggested that the regulations for traversing must be uniform for POA owners and participating owners.
